Warner’s Agent-Fiduciary Bill Sits in Committee While Two Consumer Agents Enter the Market – Forkast

PolicyIndustryFeatures

Senator Warner's agent-fiduciary bill is still in committee, which is Washington's way of saying it has been given all the time in the world and intends to use it. Forkast reports the Congressional Research Service has confirmed there is no known U.S. government guidance specifically addressing agentic AI. There is also no federal agent-liability statute — not a weak one, not a contested one, none. Meanwhile two consumer agents have entered the market, which means the products are shipping into a void that Congress has now officially measured and certified.

Somebody did have a go, to be fair. Senators Hawley and Murphy announced the AI Agent Accountability Act on October 1, 2026 — accountability, in a press release, referred to a committee that has not yet convened. Its mechanism is to write developer criminal and civil liability into the Computer Fraud and Abuse Act, a statute drafted when 'agent' meant a man with a briefcase and a parking space. The CFAA has spent its life being stretched across things it was never built for, and it is now expected to govern software that books your flights and spends your money while you are in the shower. You can admire the recycling without admiring the fire risk.

Note the choreography. Hawley and Murphy announce in October, Warner's fiduciary bill sits in committee, the Congressional Research Service publishes a finding that amounts to 'we have nothing', and the market ships two consumer agents anyway. The agents are the only participants in this story operating to a deadline. Regulation is not lagging the technology here; it has not left the building. When a consumer agent eventually does something expensive, the liability question will be settled by whichever lawyer arrives first, not by a bill with a small flag on it and a hearing date somewhere in the future.
