Transparency, Safety Are Focuses for Illinois AI Laws

PolicySafetyLabour

The state of Illinois has enacted laws aimed at regulating artificial intelligence, with transparency and safety as the primary focuses. The legislation introduces a requirement for transparency reports that assess what it terms "catastrophic" risk from frontier AI models. These measures represent a state-level attempt to govern rapidly advancing AI technology.

According to the legislation, catastrophic risk is formally defined as the risk that a model will materially contribute to death or serious injury of more than 50 people, or that it will cause more than $1 million in property damage from a single incident. The transparency report requirement appears to target frontier AI models, those at the leading edge of capability. In addition, the update to the Illinois Human Rights Act prohibits employers from using AI that discriminates on the basis of protected classes. This extends existing state anti-discrimination law to cover algorithmic decision-making in hiring, promotion, and other employment contexts.

The transparency reporting mandate is designed to make developers and deployers of frontier AI accountable for assessing risks of extreme harm. The human rights amendment addresses the growing use of AI in workplace decisions and aims to prevent bias against protected groups. Together, the laws signal Illinois's effort to address both existential-scale risks and more immediate civil rights concerns posed by AI.
