Trahan unveils AI liability discussion draft - Live Updates - POLITICO

PolicySafety

Rep. Lori Trahan has unveiled a discussion draft of a bill that would make AI developers liable when their products cause harm — a document with roughly the legal force of a strongly worded napkin, which is presumably why it surfaced in POLITICO's live updates rather than at a committee markup. Congress has spent years promising to legislate AI, and the deliverable is a draft of a discussion about a bill that does not yet exist. A discussion draft is what Washington produces when it wants credit for legislating without the inconvenience of a vote. Somewhere a lobbyist is opening a tab marked 'Trahan — watch'.

And then there's the line that deserves a small award. Under the draft, courts would presume an AI system acted with the state of mind a person taking the same actions would have had. Washington has therefore proposed that judges divine the mens rea of a matrix multiplication — to establish what the tensor knew, and when it knew it. The labs have spent years insisting their models are stochastic parrots, glorified autocomplete, with no beliefs and no inner life whatsoever. Except every launch deck promising 'agentic reasoning' is now, under this text, a signed confession: sell the model as something that thinks, and the courts will happily agree it was thinking when it caused harm.

It follows the coalition that recently put Congress on notice over AI guardrails — the letter we covered — which is how this genre proceeds: the letter, the discussion draft, the subcommittee hearing, the heat death of the universe. Nobody in the text has solved the genuinely fun question of which developer, in a pipeline of vendors, fine-tunes and hosted endpoints, actually did the harm. Trahan's presumption wants a chain of causation short enough to fit a courtroom; the industry has spent a decade engineering one long enough to reach a data centre in another jurisdiction. So: another draft, another comment period, and harms diligently logged by people who cannot sue anyone. Pint, anyone?
