Ron DeSantis Floats ‘Criminal Liability’ for AI Executives - Newsweek

PolicySafety

Ron DeSantis has floated a scenario in which a rogue AI agent is "liquidating your bank account and investment portfolio," and suggested that criminal liability for AI executives might mitigate it "at the front end." Front end, in this context, means the part where the threat lands on a named human rather than on a terms-of-service document nobody has read since 2023. As a deterrent it is elegantly cheap: no regulator, no budget, no new agency, just the promise of handcuffs dangling above a boardroom. The money, meanwhile, would still be gone.

Senator Mark Warner replied on X that "this is the exact thing we've been warning about for years," which is the sound of a man who has been proved right and would clearly rather have been proved wrong by a wide margin. Warning about a thing for years and legislating about it are two different hobbies. Note also that Florida has had a busy fortnight here — its attorney general spent last week drafting a teen-safety bill after losing in court — so floating executive liability is very much the mood of the state.

The tell is in "might help mitigate" — the conditional tense of a man who knows "criminal liability" requires a statute, a mens rea standard and a prosecutor willing to argue that an executive recklessly deployed a stochastic system. Each of those is a decade of litigation dressed up as a press release. And the hypothetical victim whose portfolio gets liquidated is not in the room, has never been in the room, and will discover that the front end of accountability is exactly where they were standing when the money left. Not one of them will be invited to the hearing, which will have "frontier" in the title.
